1. Scope and object of the Online Shop General Conditions

These General Conditions are intended, jointly with the order form, and the other items referred to therein, to regulate the terms and conditions that govern the provision of the Online Shop Service SoWoit (hereinafter referred to as “Shop”) by SOWOIT, UNIPESSOAL LDA, with registered office at Rua de Artilharia 1, nº 51 – Pateo Bagatela – Edifício 1 – 4th floor, Lisbon under the single registration and identification of legal person Number 517061716, hereinafter referred to as “SoWoit”.

The shop consists of providing through the website www.sowoit.com access to an online shop that allows the Customer to order products online in the terms and conditions described herein.

Only with the acceptance of these terms will the agreement between SoWoit and the Customer be formed.

The version in force in every moment of these General Conditions is available on the www.sowoit.com

2. Product Information and Content

SoWoit will do everything possible so that the information presented at the website and flyers does not contain errors. 

If the Customer purchases a product that has different characteristics to the presented online, the Customer has the right to terminate the purchase agreement pursuant to the applicable law. Measures presented (size and weight) in the online store are approximate and may contain measurement errors.

SoWoit will do everything possible to send all the products ordered, but it is possible that in certain cases outside of SoWoit control, as human errors or incidences in the computer systems, it is not possible to provide some of the products ordered for the Customer. If any of the products are not available after making the order, the Customer will be notified via e-mail or by phone.

If that occurs the Customer will be presented with the opportunity to cancel the order with the appropriate refund if the Customer has already made the appropriate payment.

The Customer may not demand from SoWoit, other counterparts, interest or compensation, in addition to that of the return, in cases of break stocks or errors in the information provided on the site.All price information, product specifications and promotional activities may be amended at any time by SoWoit.

3. Consumer Obligations

The Customer undertakes to:

i) Provide correct personal data and addresses.

ii) Do not use false identities.

The order of products should be made by customers aged over 18 (eighteen) years. The data and information transmitted by the Customer shall enjoy the full legal effect, and the customer shall acknowledge the online purchase, whom, therefore, cannot claim that lack of signature for breach of obligations.

If any of the data is incorrect or insufficient, and for this reason, there is a delay or inability in the order processing, or if non-delivery occurs, the Customer shall be responsible for the same. SoWoit disclaims any responsibility in case of error originated by the Costumer. 

If the Customer violates any of these obligations, SoWoit reserves the right to eliminate future purchases, block access to the store, cancel the provision of any other products available by SoWoit, and also not allow the Customer future access to some or any services offered by SoWoit.

4. Privacy and Personal Data Protection

SoWoit guarantees the confidentiality of all data provided by customers.

The personal data identified in the order form as mandatory are essential to the operation of the store. The omission or inaccuracy of the data provided by the Customer is the Customer’s sole responsibility and may give a reason for the refusal of service by SoWoit.

Under applicable law, is guaranteed to the Customer, free of charge, the right to access, correct and update their personal data, directly or upon request by email to customerservice@sowoit.com.

We may eventually advertise online and disclose your personal information to Google Inc. and Facebook Inc. to provide targeted ads. You can review the Google Terms of Service and Facebook Terms of Service.

Acceptance of SoWoit privacy and personal data processing policy, accessible here is an essential condition for completing the ordering and purchasing process.

5. Cancellation of orders

At the Client’s request

The Client may request the cancellation of the Client’s order by email to customerservice@sowoit.com referring to the order number, which will be accepted if it has not yet been processed. 

If the order complies with customized items or goods as requested by the Client, SoWoit reserves the right to accept or reject the cancellation order.

For the purposes of cancellation, the Customer shall provide the following data to SoWoit:

a) Order number

b) Tax ID number that placed the order and delivery address

By decision of SoWoit

The SoWoit reserves the right to not process orders upon detection of errors or inconsistency on the personal data submitted or observe misconduct by the buyer. 

The SoWoit reserves the right not to process of any order or refund in case there are errors in the values and/or characteristics of the products when they arise from technical problems or errors unrelated to SoWoit.

SoWoit reserves the right not to process any order if there is a lack of technical means and/or raw material necessary for the completion of the order.

6. Return (Resolution Law)

With exception of the orders and products that have been customized by the Client, the Client can exercise the right of withdrawal without SoWoit requiring any compensation within 30 (thirty) days from the day on which the Customer acquires physical possession of the property.

To exercise this right, the Customer must send the below form filled to the email address [customerservice@sowoit.com] with the subject “Free Resolution.”

The Customer must, within 30 (thirty) days from the date the resolution form was sent, return by registered mail, the goods to SoWoit under appropriate conditions.

The package must be returned complete, as delivered, and accompanied by all the documentation received, including the sales invoice. The package and documents must be sent by registered mail to the following address: [Avenida Emília 179, São João do Estoril, 2765-480 Estoril, Portugal]. 

The Customer should always retain the receipt proving the shipping of the package until the refund. Shipping costs to locations outside the continental Portugal will be the Customer’s responsibility.

After receiving the return in SoWoit will refund the Customer with the amount paid for the order (sales invoice amount, including shipping costs). If The Customer used a promotional discount code, this value will not be refunded.

The method of repayment of the amount to be returned depends on the payment method of the order respective. We make such refunds using the same means of payment as you used in the initial transaction, unless otherwise expressly agreed by you; in any case, does not incur any costs because of such reimbursement. The refund is made within 14 (fourteen) working days of receipt of the form of withdrawal and the goods returned.

In the absence of any components sold or if any of them is not in excellent condition, there will not be any refund and the product will be returned to the initial shipping address.

7. Warranty

In legal terms, SoWoit’ items have a warranty of 2 years period from the date of invoice, applied only to situations of declared and duly proven defects. Normal wear and tear are not covered by this warranty. The SoWoit items are delicate so remember the main precautions: Avoid contact with water and abrasive products and clean it only with a soft, dry cloth, following the instructions provided.

Are considered outside the warranty conditions the items that have defects caused by abnormal wear, negligence or accidents and missing components.

If the Customer is facing any nonconformity, send an email with the subject “Guarantee” for [customerservice@sowoit.com], stating the order number, date of invoice and Customer address. The Customer should then send the item, via registered mail to the following address: [Avenida Emília 179, São João do Estoril, 2765-480 Estoril, Portugal]. The Customer should always retain proof of the shipping of the package. Shipping costs will be the Customer’s responsibility.

After examination and confirmation of the validity of the guarantee, the product will be repaired or replaced at no charge and returned to the Customer’s address.

8. Communications

Without prejudice to other forms of communication provided for in the General Conditions, the notifications made to the Customer that relate to the shop may be made to the email Customer’s address, SMS or phone.

The Customer agrees to receive any communication and/or notification relating to the Online Shop to the address, contact number and or email address (“email”) indicated in the ordering process.

At any time, the Customer can request not to receive these communications and/or notifications via the Contact Form or through the option “Do not receive the Newsletter” inscribed on each Newsletter.

9. Dispute Resolution

The Customer may submit any contractual disputes, to the mechanisms of arbitration and mediation that are or may be legally constituted and lodge a complaint with SoWoit of acts and omissions that violate the legal provisions applicable to the purchase of goods.

10. Applicable Law

The parties agree that their relations will be exclusively governed by these Terms and Conditions and the Information available on the site. In case of omission of any condition, this will be considered governed by habits and customs in force in distance selling practices, according to the provisions of the Code of Ethics and Loyal Practices of the AMD – Portuguese Association of Direct Marketing and other legislation in force. 

All products sold in SoWoit Online Shop are in accordance with the Portuguese Law.
